After denouncing the National Rifle Association in an open letter this past March, artist Anish Kapoor filed a copyright infringement lawsuit against the group on June 19 for the unauthorized use of an image of his famous “Cloud Gate” sculpture in this 2017 ad titled “The Clenched Fist of Truth”. Kapoor filed the complaint in the U.S. District Court for the Northern District of Illinois.

A photographer can copyright the individual photo of a public building or public artwork. The architect or artist of the public building or public artwork cannot prevent those structures from being photographed. If the building or artwork were privately owned they could do so as a homeowner can have his house deleted from the groundview of Google Earth. This is meaningless virtue signaling by the artist. 17 US Code 120 applies.
Preventing the photography of public buildings such as jails and prisons and immigration centers would lead to governmental abuse and massive repression of everyone's civil rights. It would help lead to '1984' on steroids.
Here is a photo of the building used as the ministry of propaganda in the UK in WW II, basis of George Orwell's 'Ministry of Truth'. Should photography of this building be banned also?

Is he suing because an ad he opposes includes his building? Or includes a copyrighted image of his building?
