Use of a representation of a building in a mural legal?

LBG

Hi All, I am commissioning a mural and have been told by the owners that I cannot use the representation of the building in part of a mural that will be located in a public space. Can they legally do that? Does Copyrights - 17 USC Section 120 apply?

Thanks!

Contact a lawyer... but nope!

Architectural copyright pretty much applies to "blueprints" only. And unless the work in question has significant ornamentation, there's little regard for other types of copyright protection.

So, unless there's a large variety of art, advertising, sculpture et cetera... but the copyright of those works is of their creators and designers; not the building owner's.

If the building was built or submitted before 1990, there's no copyright protection.

And lastly, your use would fall under "Fair Use" otherwise because you're using it for an educational, research, artistic et cetera purpose.
