Interesting real estate issue that I have experience with. The fact is The Church owns the building.
As an example, many protestant congregations believe they own their church buildings and think they can sell their property. But if you represent a client who is buying be wary of the name on the deed. To keep the property tax exempt they put the deed in the churches name, but who owns the "church" as an entity? The Church does, whether it be a synod or other umbrella organization. Even though the people of the congregation paid for it, they did so with tax exempt dollars as donations to "The Church".
Churches are very lax in documenting this fact and the Catholic Church is no exception. In this particular case it will ultimately come down to who paid to build it and back in the day when this was built it was The Catholic Church when nuns and sisters were "employees".
Churches let congregations and orders run fast and lose with their property until the day it gets sold and the proceeds don't get reinvested in a new church building, then that is the day they do the big reveal.... watch out if you ever try to buy one.
