it may be possible, if it is in a multifamily building and can meet light, air and egress requirements (and depending on zoning). if your building is a house, the lower level has to be more than 50% above ground or you can't legally use it as living space.

I want convert some cellar area in my apartment building to a dwelling
unit in NYC, is it possible and how difficult it is to get approval?
