<img src="https://archinect.gumlet.io/uploads/96/96887efc66094a6ede1a10ed3e371023.jpg?fit=crop&auto=compress%2Cformat&enlarge=true&w=1200" border="0" /><p>Several local New York outlets have <a href="https://www.nytimes.com/2024/10/23/realestate/chrysler-building-lawsuits-cooper-union.html" target="_blank">reported</a> an update on the financial dispute between the <a href="https://archinect.com/news/tag/1251970/chrysler-building" target="_blank">Chrysler Building</a>’s owner-operator RFR and <a href="https://archinect.com/schools/cover/697/the-cooper-union" target="_blank">The Cooper Union</a>, which has held the land use rights to its lot since 1902.</p>
<p>The Austrian-based developer purchased William Van Alen’s landmarked design <a href="https://archinect.com/news/article/150125946/the-chrysler-building-sells-for-a-mere-150-million" target="_blank">for $150 million in 2019</a> and is now being threatened with eviction by the college after reportedly not paying rent since May. RFR in turn filed a lawsuit last month, claiming "an improper and fatally defective eviction proceeding" on the part of Cooper Union. </p>
<p>The ground rent is now expected to increase to $41 million by 2028, adding to the challenges posed by its <a href="https://archinect.com/news/article/150437751/can-the-chrysler-building-still-endure-against-imposing-contemporary-neighbors" target="_blank">inability to retain tenants</a> because of poor cell phone reception and unsanitary taps. The suit also claims Cooper Union's reaction to student-led anti-war protests this past year has led others to withdraw. The college has since called these claims "irrelevant, scandalous, and prejudicial.”</p>

<img src="https://archinect.gumlet.io/uploads/15/153f2b35b009ed93af4019df15f26332.jpg?fit=crop&auto=compress%2Cformat&enlarge=true&w=1200" border="0" /><p>The embattled owner of <a href="https://archinect.com/news/tag/4673/frank-lloyd-wright" target="_blank">Frank Lloyd Wright</a>’s landmark Price Tower in Bartlesville Oklahoma has filed suit against The Frank Lloyd Wright Building Conservancy in order to void liens which have been placed on the property, the <em><a href="https://www.nytimes.com/2024/10/22/arts/design/frank-lloyd-wright-skyscraper-price-tower-lawsuit.html?smtyp=cur&smid=tw-nytimesarts" target="_blank">New York Times</a></em> is reporting. The nonprofit had <a href="https://archinect.com/news/article/150440864/frank-lloyd-wright-building-conservancy-files-ucc-claims-over-sale-of-original-price-tower-items" target="_blank">previously taken action</a> against the Copper Tree Group, which is managed by investor Cynthia Blanchard, in order to prevent sales of original furniture from the building that were under the protection of a preservation easement dating to 2011.</p>
<p>Blanchard's attorneys are repeating their original claims that the orders no longer pertain post-sale. The company is now seeking $75,000 in damages in addition to an injunction against the Conservancy for "interfering" with the sale of the building or furniture. In yet another complication, the <em>Times</em> reports its <a href="https://archinect.com/news/article/150442927/frank-lloyd-wright-s-price-tower-to-be-auctioned-online-in-october" target="_blank">previously scheduled</a> October 7th auction has been pushed back to November 18th in response to a separate lawsuit from a Tulsa-based developer who claims to have signed ...</p>

The employee in question, Todd Novak, claims he notified senior leadership that there was between $2-6 million absent from its balance sheets while in the process of applying internally for a CEO position. </p>
<p>The outlet says: "The suit accuses RSP of retaliation in violation of the Minnesota Whistleblower Act and seeks unspecified compensation for loss of income, mental anguish, emotional distress and other financial and emotional loss." </p>
<p>Novak was later laid off in a cost-saving move in March. Another caveat, per the <em>Star Tribune</em>: "The missing funds mattered for several reasons, including that RSP ran an employee stock ownership plan that was funded based on company profits."</p>

Kathy Hochul in court. A group of local advocates filed a pair of lawsuits against the governor on Thursday, claiming she lacked the legal authority to order the MTA to pause the Manhattan tolling program last month. It was originally scheduled to launch on June 30 until Hochul made an eleventh-hour declaration that it would not move forward.</p></em><br /><br /><p>It seemed as though the long debated <a href="https://archinect.com/news/tag/462338/congestion-pricing" target="_blank">congestion pricing</a> program was finally on its way following the Federal Highway Administration's <a href="https://archinect.com/news/article/150354922/new-york-city-s-congestion-pricing-program-receives-federal-approval" target="_blank">approval of the program</a> in June of last year.</p>

Critics also believe Hochul's move was a political decision to appease voters in regions against congestion pricing. The above lawsuits are expected to go before a judge in September. </p>

<p>The project is <a href="https://archinect.com/news/article/150335076/toronto-s-proposed-ontario-place-redevelopment-is-getting-even-more-contentious" target="_blank">contentious</a> on both heritage and environmental grounds and has likewise drawn ire from its reported costs north of $650 million CAD ($476 million USD) to taxpayers. <a href="https://archinect.com/news/tag/2073899/therme" target="_blank">Therme</a>, the company behind the plan, had previously signed a 95-year lease with the city government.</p>
<p>The removal of <a href="https://archinect.com/news/tag/429196/raymond-moriyama" target="_blank">Raymond Moriyama</a>'s Ontario Science Centre, which is at the heart of the issue, is also stirring debate after it <a href="https://torontosun.com/news/local-news/ontario-science-centre-abruptly-closing-due-to-roof-issues" target="_blank">closed abruptly</a> last week over fears of collapse stemming from the flawed RAAC concrete materials used in its roof. He was intent on cutting off the water and the power (and removing the house’s cable and wiring, which ran through the concrete in plastic tubes). Renée Daoust is suing the federal government after it replaced hers with a proposal from the Indigenous artist Adrian Stimson citing an apparently “un-scientific” online survey, according to the CBC’s reporting <a href="https://www.cbc.ca/news/politics/afghan-war-memorial-daoust-stimson-1.7162311" target="_blank">last month</a>.</p>
<p>"We're very concerned because it does create a precedent, a very dangerous precedent for Canada in terms of competitions, public art competitions, architectural competitions and so on," Daoust told the broadcaster. "There was political interference, so we don't want this to happen again."</p>
<p>Stimson is reportedly working to finalize his design without a clear resolution in sight. <p>The <em><a href="https://www.nytimes.com/2024/03/27/arts/design/kim-kardashian-table-donald-judd.html?utm_source=pocket_saves" target="_blank">New York Times</a> </em>and <a href="https://www.tmz.com/2024/03/27/kim-kardashian-sued-artist-donald-judd-trademark-infringement-knockoff/" target="_blank">TMZ</a> are reporting on the lawsuit this week, which stems from a YouTube video tour of the makeup company's California offices that was uploaded in 2022.</p>
<p>The suit claims Kardashian unwittingly made damaging comments that could mislead consumers into believing the celebrity skincare mogul was endorsing the Judd Foundation (she and her <a href="https://archinect.com/news/tag/131961/kanye-west" target="_blank">ex-husband</a> are, after all, both outspoken proponents of Judd and other minimalist icons like <a href="https://archinect.com/news/tag/139634/james-turrell" target="_blank">James Turrell)</a>.</p>

<p>In the suit, SmithGroup alleges that the termination of their contract for the new Joan Secchia Children’s Rehabilitation Hospital never resulted in the required payment of licensing and other fees on the part of the hospital. They say that, in the aftermath, the hospital “improperly copied, reproduced, prepared derivative works” before sharing the plans with other architects, “willfully” infringing the copyright to generate new renderings. </p>
<p>Both the firm and the hospital are denying these claims publically. The $60 million project is expected to get underway this spring and be completed in 2026...</p>

The case involves Swiss architect <a href="https://archinect.com/news/article/150140381/valerio-olgiati-offers-an-alternative-to-harvard-gsd-expansion" target="_blank">Valerio Olgiati</a> versus <a href="https://arch.vt.edu/faculty-staff/faculty/breitschmid-markus.html" target="_blank">Markus Breitschmid</a>, an architect and architecture professor at <a href="https://archinect.com/schools/cover/764/virginia-polytechnic-institute-and-state-university-virginia-tech" target="_blank">Virginia Tech</a>, and is being heard in the U.S. District Court for the Western District of Virginia. As we <a href="https://archinect.com/news/article/150282176/kanye-west-s-favorite-architect-is-drawing-some-seriously-high-praise" target="_blank">previously reported</a>, Olgiati has served as Kenzo Tange Chair at the <a href="https://archinect.com/harvard" target="_blank">Harvard GSD</a>.</p>
<p>The origins of the case stem from a dispute between Olgiati and Breitschmid over a house designed and built in <a href="https://archinect.com/news/tag/30429/virginia" target="_blank">Virginia</a>. The two architects have known each other since 2006 and have collaborated on several projects, including <a href="https://www.park-books.com/en/product/non-referential-architecture/137" target="_blank">co-publishing books</a>. </p>

<p>The museum will now restrict visitors' access to the platform, which was constructed in 2016 as part of a <a href="https://archinect.com/firms/cover/577/herzog-de-meuron" target="_blank">Herzog & de Meuron</a>-led $318 million Blavatnik Building <a href="https://archinect.com/news/article/149946793/first-look-inside-tate-modern-s-new-extension" target="_blank">expansion</a>. The remedy will help the Tate avoid paying any monetary damages, as was the will of the plaintiffs. It filed suit Tuesday to recover nearly $70,000 in back wages, penalties and interest for stiffing a former executive assistant.</p></em><br /><br /><p>Rex Heuermann, an architect, was <a href="https://archinect.com/news/article/150356697/suspected-long-island-serial-killer-rex-heuermann-was-a-manhattan-based-architect" target="_blank">arrested in July</a> near his firm’s Midtown Manhattan offices on charges related to the murders of three women. Their remains were discovered at Gilgo Beach in 2010. In a separate legal matter, Heuermann and his architectural firm, RH Consultants & Associates, are accused of wage theft. They allegedly underpaid an employee, Donna Sturman, by more than $20,908.10, which includes $9,454.56 owed to her as vacation pay. Before his arrest, Heuermann had paid $16,385 towards the owed amount. However, he defaulted on the remaining balance, leading to a lawsuit. As a result, he now owes an additional $33,362.16 in civil penalties and $9,767.48 in interest.</p>
<p>His firm has been the subject of scrutiny since Heuermann became a suspect. The city’s lawsuit was filed May 17 in state Supreme Court in Manhattan. The defendants are Steven Holl Architect, PC, aka Steven Holl Architects, and the individuals Steven Holl and Christopher McVoy.</p></em><br /><br /><p>The <a href="https://archinect.com/news/article/150172198/class-action-lawsuit-filed-in-hunters-point-library-accessibility-dispute" target="_blank">original lawsuit</a> was brought to Federal court in November 2019 by a local disability advocate named Tanya Jackson. New York State has decreed that it is, and Gov. Kathy Hochul has recently likened the Penn Station area to “a Skid Row neighborhood.” She was defending the controversial plan to allow developers to build 10 towers around the decrepit train station — the busiest transit hub in the nation — in exchange for some of the $7 billion the state needs to renovate it.</p></em><br /><br /><p>The same tactic was used in the urban cores of major American cities such as <a href="https://archinect.com/news/article/150316957/now-you-can-experience-la-s-erstwhile-bunker-hill-neighborhood-thanks-to-a-3d-reconstruction-from-usc" target="_blank">Los Angeles</a> to break apart mostly residential areas and redevelop them into high-rise-laden commercial districts, a practice which may now be <a href="https://archinect.com/news/article/150322031/zoom-town-to-boom-town-north-american-business-districts-are-going-to-evolve-instead-of-dying-off-completely" target="_blank">boomeranging</a> in the post-pandemic economy. New York is claiming “economic stagnation” (in addition to “blight”) in the redeveloped area. However, opponents say only 8 of the total 61 lots targeted by the project meet the definition outlined by the state’s apparently vague threshold. </p>
<p>“It’s so extreme in this case, I don’t think they can get away with it,” an attorney representing various opposition groups’ legal challenge to the plan told the <em>Times</em>.</p>

<p>The UK <a href="https://www.architectsjournal.co.uk/news/foster-partners-takes-indian-state-body-to-court-for-non-payment" target="_blank"><em>Architects’ Journal</em></a> is reporting that the suit was brought against the state-run Amaravati Metropolitan Region Development Authority (AMRDA) over their repeated inability to respond to payment requests from Foster + Partners that date to 2019. </p>
<p>Foster + Partners had worked alongside AMRDA for a period of several years to develop an administrative city for the state of Andhra Pradesh that included a new legislative building, judicial facilities, and a complex of office buildings at a reported price of £500 million ($600 million USD).</p>

<p><a href="https://www.nola.com/news/business/article_eed75178-c737-11ec-8011-fbcf5b31b6d7.html" target="_blank"><em>NOLA.com</em></a> is reporting that the foundation will pay a total of $20.5 million in the form of individual $25,000 reimbursements available to any plaintiffs covered by the class action suit, which was <a href="https://archinect.com/news/article/150084386/brad-pitt-s-foundation-facing-lawsuit-for-post-katrina-homes-amidst-reports-they-are-falling-apart" target="_blank">first initiated</a> in 2018.</p>
<p>The foundation’s attorneys did not immediately comment on the outcome of the highly-publicized case, which stems from flawed <a href="https://archinect.com/news/article/150087247/brad-pitt-s-make-it-right-foundation-sues-architect-for-flawed-designs" target="_blank">designs</a>, faulty <a href="https://archinect.com/news/article/150166721/brad-pitt-make-it-right-face-lawsuit-for-shoddy-construction" target="_blank">construction techniques</a>, rotting <a href="https://archinect.com/news/article/90300008/wood-product-said-to-be-rotting-in-make-it-right-homes-in-new-orleans" target="_blank">building materials</a>, and unsafe living conditions documented in nearly all of the 109 total homes built between 2008 and 2015 through the foundation. Teams from four universities are preparing final proposals, which are due on August 15th. But a pending lawsuit presents a potential hang-up for those plans and the parties are due in state Supreme Court on Tuesday morning.</p></em><br /><br /><p>Last year, the <a href="https://archinect.com/news/tag/12384/new-york-city" target="_blank">New York City</a> Council voted to rezone the southern end of <a href="https://archinect.com/news/tag/313274/governors-island" target="_blank">Governor’s Island</a>, paving the way for 3.7 million square feet of new development, including office, hotel, and retail space. The plan also includes a move to establish a long-awaited climate research center. However, the rezoning also leaves a lot of room for more commercial development, which would allow for higher building heights and more car-oriented planning, a move that has been met with opposition. </p>

According to a lawsuit filed Thursday in federal court by the U.S. Attorney's office in Chicago, the Cubs "failed to ensure that recent additions and alterations at Wrigley Field are readily accessible to and usable by individuals with disabilities.”</p></em><br /><br /><p>Between 2014 and 2019, Wrigley Field underwent a significant overhaul known as “The 1060 Project,” which included new seats, expanded bleachers, a new outdoor concourse, new concessions, upgraded restrooms, new team clubhouses, and more. </p>
<p>The alleged violations to the <a href="https://archinect.com/news/tag/182457/ada" target="_blank">ADA</a> Standards for Accessible Design were first recognized by the Department of Justice in November 2019. The <a href="https://www.scribd.com/document/582595915/Cubs-Lawsuit" target="_blank">lawsuit claims</a> the franchise didn’t provide wheelchair users with adequate sightlines, that are further worsened when other fans stand during games. In the general admission areas, wheelchair seating is mainly grouped in the last row of seating sections. Lake Mary Jane is suing property developers Beachline South Residential in Florida state court over the developer’s plans to construct a new development on the north side of the lake, converting 1,900 acres of wetlands and forests into a mixed-use residential, commercial, and office development.</p>
